Law: PretextingPretextin is a controversial data collecting technique in which false pretenses are used to obtain private date. For example, in a recent case with Hewlett Packard, investigators are alleged to have posed as board members, and members of the press, to trick phone companies into revealing phone records of the real board members. As of September 2006, there is a bill in Congress to make pretexting specifically illegal. Pretexting is commonly used to weed out housing or employment discrimination.According to David Hricik, who teahes at the Mercer University Walter F. George School of Law, using trickery like pretexting to catch a discriminatory landlord serves a social good, while using it to obtain cell phone records could be a crime. Pam Anderson, chairwoman of the Washington State Bar Association's Rules of Professional Conduct Committee says "What lawyers should not be doing is directing someone to try to circumvent the laws that restrict disclosure of information."
